Winter Writing Workshop Waiver
1) Recording & Media Consent. Second Street Music ("SSM") may photograph, film, live‑stream, and audio‑record me at the Event and use the resulting media worldwide, forever, without payment for promotion, documentation, education, and related SSM activities. I may repost clips of myself for my own non‑commercial promotion with credit to SSM.
2) New Songs Made Tonight (Compositions). If we create a new song (a “Work”) together at the Event, the Writer’s Share is split equally among all contributors listed on that Work’s Split Sheet (unless a different split is written there and signed by all writers). SSM (or an SSM affiliate) will be the publisher of record and will own 100% of the Publisher’s Share for each Work and will administer the Work (registrations, licensing, collections, accounting for the Publisher’s Share). I authorize SSM to register each Work with the relevant organizations (e.g., ASCAP, The MLC) using the splits on the Split Sheet, and I will promptly provide my legal name, PRO, and IPI/CAE.
3) Workshop Recordings (Masters). SSM owns all right, title, and interest in the sound recordings captured at the Event (the “Workshop Recordings”). SSM may record, edit, mix, reproduce, distribute, publicly perform, display, transmit, and otherwise use the Workshop Recordings in any and all media, now known or later developed, worldwide and in perpetuity.
Artist/Writers’ personal‑use license: SSM grants each featured artist and writer a non‑exclusive, worldwide, royalty‑free license to use reasonable excerpts of the Workshop Recordings for non‑commercial self‑promotion (EPK, website, social posts, showreel) with credit to Second Street Music. Any commercial release, monetized upload, sync, or distribution by participants requires SSM’s prior written approval.
4) Studio Rules & Safety.** I’ll follow SSM’s communication rules (no playing outside of rehearsals/takes; follow producer direction). I understand normal studio risks (sound levels, cables, equipment) and assume those risks.
4a) Release & Hold Harmless. To the fullest extent allowed by Pennsylvania law, I release and hold harmless SSM and its personnel from claims arising from my participation except those caused by SSM’s gross negligence or willful misconduct. I agree to indemnify SSM for claims arising from my breach of this agreement or my unlawful acts.
4b) Media Sharing & Privacy. SSM may share Event media with third‑party platforms and partners for lawful uses tied to SSM’s activities. SSM will not sell my personal information.
5) No Compensation. I understand there is no payment for attending or for SSM’s permitted uses.
6) Legal Terms. This agreement is effective on signature, applies worldwide, and is governed by Pennsylvania law. It is the entire agreement for tonight’s Event media/recording/publishing terms and may be signed electronically. If I am under 18, a parent/guardian must also sign.
Split Sheet (attached per song). Default rule = equal writer splits among the listed writers; Publisher: SSM (100%). If a different split is agreed, write exact percentages on the Split Sheet; the signed Split Sheet controls for that song.
